Tune In Foundation Terms of Use

These Terms of Use govern your access to and use of tuneinfoundation.org and any forms, registrations, contribution tools, content or services made available through the website (collectively, the “Website”).
By using the Website, you agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use the Website.
1. About Tune In Foundation
Tune In Foundation is an incorporated Canadian nonprofit organization based in Hamilton, Ontario. We provide music education, artist development, youth leadership, mentorship and arts-integrated community programming.
Tune In Foundation is not a registered charity and cannot issue official charitable donation receipts.
2. Contributions, Payments and Receipts
Contributions made through the Website are made to Tune In Foundation unless the applicable payment page clearly states otherwise.
Because Tune In Foundation is not a registered charity:
- Contributions are not eligible for charitable tax credits
- Tune In Foundation does not issue official donation tax receipts
- Any email, payment confirmation or acknowledgment you receive is for transaction-record purposes only and is not an official charitable receipt
- No third-party charity or charity liaison issues receipts on Tune In Foundation’s behalf
Contributions support Tune In Foundation’s nonprofit mission and programs. Unless a campaign expressly states that funds are restricted to a specific purpose, Tune In Foundation may allocate contributions to the area of greatest need in support of its mission. We will make reasonable efforts to consider donor preferences communicated before or at the time of a contribution, but we cannot guarantee that every preference can be treated as a legally restricted gift.
Payments may be processed by a third-party provider. Your use of that provider’s services may be subject to its own terms and privacy policy.
Except where required by law or where a transaction was made in error, contributions are generally non-refundable. Event tickets, program fees, merchandise and other purchases may be subject to additional refund, cancellation or transfer terms shown at the time of purchase. 3. Youth, Parents and Guardians
Tune In Foundation offers programs and activities for youth. If you are under the age of majority where you live, you must have permission from a parent or legal guardian to submit personal information, register, apply, make a payment or otherwise use an interactive feature of the Website.
Program-specific registration forms, releases, codes of conduct, media permissions, safety requirements and parent or guardian consents may also apply. If program-specific terms conflict with these Website terms, the program-specific terms will govern for that program.
Parents and guardians are encouraged to review online activities and submissions with young participants.
4. Program and Event Information
Program, event, workshop and opportunity information is provided for general information and may change. Dates, locations, facilitators, eligibility requirements, capacity and content may be updated, postponed or cancelled where reasonably necessary.
Submitting an application or registration does not guarantee acceptance, participation, funding, an award, employment, representation or any particular outcome. We may establish reasonable eligibility, safety, conduct and capacity requirements for programs and events.
You agree that information you submit will be accurate and that you have authority to provide it.
5. Acceptable Use
You may use the Website only for lawful, personal and legitimate organizational purposes.
You must not:
- Misrepresent your identity or affiliation
- Submit information that is false, fraudulent, defamatory, discriminatory, threatening, harassing, obscene or unlawful
- Infringe intellectual-property, privacy, publicity or other rights
- Upload malware or attempt to interfere with the Website’s security, operation or availability
- Attempt to gain unauthorized access to accounts, systems or information
- Scrape, harvest or collect personal information from the Website without permission
- Use the Website to send spam or unauthorized advertising
- Use Website content in a way that falsely suggests Tune In Foundation’s endorsement, sponsorship or partnership
We may restrict access, remove submitted material or take other reasonable action where we believe these Terms, another applicable policy or the law has been violated.
6. Website Content and Intellectual Property
Unless otherwise stated, the Website and its original content—including text, graphics, logos, photographs, video, audio, design and program materials—are owned by or licensed to Tune In Foundation and are protected by applicable intellectual-property laws.
You may view, download or print reasonable portions of the Website for personal, educational and non-commercial use, provided that you do not remove ownership notices or misrepresent the material.
Any other reproduction, modification, publication, distribution, sale, commercial use or creation of derivative works requires prior written permission from Tune In Foundation or the applicable rights holder.
“Tune In Foundation,” its logo, program names and related brand elements may not be used in a manner that suggests endorsement or affiliation without written permission.
7. Material You Submit
You retain ownership of original material you submit, such as application content, comments, photographs, audio, video or testimonials.
When you intentionally submit material for publication, promotion, program administration or evaluation, you grant Tune In Foundation a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt and display that material only for the purpose for which it was submitted and for related nonprofit communications, subject to applicable consent forms and privacy requirements.
Separate media releases, participant agreements or project contracts may provide more specific terms. We will not rely on this section to override a specific written agreement or consent choice.
You confirm that you have the rights and permissions needed to submit the material.
8. Privacy
Our collection, use and disclosure of personal information is described in our Privacy Policy. By using forms, payment tools or other third-party services connected to the Website, you acknowledge that those providers may also apply their own terms and privacy policies.
9. Third-Party Websites and Services
The Website may link to or embed third-party websites, social platforms, forms, videos, ticketing pages, payment tools or other services. Tune In Foundation does not control those services and is not responsible for their availability, security, content, products or privacy practices.
A link or embed does not necessarily mean that Tune In Foundation endorses every statement, product or service offered by the third party. Use third-party services at your own discretion and review their applicable terms.
10. Information and Availability
We make reasonable efforts to keep Website information accurate and current, but errors, omissions or outdated information may occur. Content is provided for general informational purposes and is not legal, financial, medical or other professional advice.
We do not guarantee that the Website will always be available, uninterrupted, secure or error-free. We may change, suspend or discontinue part of the Website without notice where reasonably necessary.

To the extent permitted by law, the Website is provided on an “as is” and “as available” basis. Tune In Foundation disclaims warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Nothing in these Terms excludes any warranty or consumer right that cannot legally be excluded.

To the extent permitted by law, Tune In Foundation and its directors, officers, employees, contractors, volunteers and service providers will not be liable for indirect, incidental, special, consequential or punitive damages arising from use of, inability to use or reliance on the Website or a third-party service.
This limitation does not apply to liability that cannot lawfully be limited or excluded. Your rights may vary by jurisdiction.
13. Responsibility for Misuse
You are responsible for losses, claims or expenses reasonably arising from your unlawful use of the Website, your material breach of these Terms or your infringement of another person’s rights, to the extent permitted by law.
14. Changes to These Terms
We may update these Terms when the Website, our programs, payment arrangements or legal obligations change. The current version will be posted on this page with a revised “Last updated” date.
Your continued use of the Website after an update means that you accept the revised Terms. Material changes may also be communicated through the Website or another appropriate channel.
15. Suspension and Termination
We may suspend or terminate access to an interactive Website feature where reasonably necessary to protect participants, users, Tune In Foundation, its partners or the security and integrity of the Website.
Terms that by their nature should continue after termination—including intellectual-property, disclaimer, limitation-of-liability and governing-law provisions—will continue to apply.
16. Governing Law
These Terms and your use of the Website are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.
Subject to any rights that cannot be waived, disputes relating to these Terms or the Website will be brought before the courts located in Ontario.

If any provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
A failure to enforce a provision is not a waiver of that provision.
These Terms, together with the Privacy Policy and any specific terms presented for a program, event or transaction, form the agreement governing your use of the Website.
